Terms of Service

These terms govern your use of HAMANI Marketing, provided by HAMANI PTY LTD. By using the service you agree to them.

What HAMANI is

HAMANI Marketing is marketing software for your business. We provide the tools to plan, draft and send campaigns; we are not your marketing agency and we do not send on your behalf without your action.

You are the sender (Spam Act 2003)

When you send email through HAMANI, you are the sender and remain responsible for consent, accurate sender identification, and one-click unsubscribe under the Spam Act 2003 (Cth) — for your own list. Our tools require sender identification and add a one-click unsubscribe to every message, and block messages that use deceptive urgency, but the lawful basis to contact your audience is yours.

AI-assisted drafts & standard-template mode

HAMANI CONCIERGE can draft and translate copy from a short prompt. AI-assisted output is a draft starting point you review before you use or send it. See our AI Disclosure.

If the AI service is unavailable, the platform continues operating on its built-in, pre-validated standard templates — campaign creation, sending, and billing are not dependent on the AI. The service switches back to AI drafting automatically when it recovers, and the interface tells you which mode is active.

Command & voice interface

You can operate the service by typed commands and, on supporting browsers, by voice. No action runs without your on-screen confirmation. Voice input and spoken replies use your browser’s own speech services(for example, your device or browser vendor’s speech recognition) — HAMANI does not receive or store voice recordings, and your browser vendor’s own terms govern that processing. Typed commands work identically everywhere.

Spend approval, suggestions & notifications

Nothing is spent or committed from your prepaid credit without your explicit approval. The service (including its AI and automated maintenance jobs) may only raise a suggestion — shown in your dashboard and sent to your account email — stating the projected cost and expected benefit. You approve or decline; a declined suggestion is not raised again; and even an approval only takes you to the normal checkout or activation step, where the charge itself still requires your action.

Automated optimisation agents (the agent mesh) are off by default and run only after you enable them — that click is recorded as your approval. When enabled, they operate strictly within budgets you have already approved: they may tune campaigns you activated (for example adding an A/B subject variant, with volume shifting to the version that generates fewer unsubscribes), and they can never spend, commit or top up credit. Every agent action is recorded in your workspace audit history, and you can retire, freeze or disable agents at any time.

Connected tools & complimentary use

The service can invoke registered tools (including tools provided by other HAMANI products). Each invocation shows you the tool’s purpose and per-use cost and runs only with your permission. Where a tool’s per-use cost is under $1.00 we may, at our discretion, provide the use free of charge — a complimentary use is recorded in your account history and never appears as a charge. We may change which uses are complimentary at any time; any change only affects future invocations, which always display their cost first.

API access & acceptable use

Your account includes access to our documented REST API and webhooks (see /developers) at no separate charge — messages sent via the API are billed at the same per-message rates as the app, and only when a message is accepted for sending by our delivery provider (queued, failed, and simulated sends are never charged). API use is subject to these Terms, the Acceptable Use Policy, and the Spam Act 2003 (Cth) exactly as in-app use is: the same consent, sender-identity and unsubscribe rules are enforced by the API itself.

API keys are yours to protect. Keys are shown once and stored by us only as a hash; you are responsible for storing them securely, restricting their scopes, and revoking a key immediately if it may have leaked. Actions taken with your keys are taken by you. Rate limits apply per key and we may adjust them, throttle, or suspend API access to protect the service or other customers; deliberate abuse (including attempts to bypass consent or rate controls) may lead to suspension under the Acceptable Use Policy. Webhook endpoints you register are systems you control — keep the signing secret safe and verify signatures on every delivery.

Enterprise: SSO, team seats, SLA & DPA

Enterprise customers can federate their own identity provider for single sign-on (SAML 2.0 or OIDC) and run multiple team seats with role-based access. HAMANI remains the system of record— your identity provider proves who a user is; your account, workspace, data and roles stay with HAMANI. You are responsible for your identity provider’s configuration and for promptly removing access when someone leaves; our controls apply access changes immediately on our side.

Seat licensing: team members you invite act under the role you assign. The enterprise features (SSO, seats, data export, audit export) are provided at no separate platform fee today, on the same per-message rates as any account; any future seat, committed-volume, or support-tier pricing is set in your written agreement, never applied by surprise.

SLA: an uptime and support commitment applies only where you have a signed Service Level Agreement; self-serve accounts are provided without an uptime commitment. DPA: our Data Processing Agreement, once executed, is incorporated into these Terms and governs our processing of your audience’s personal information as your processor under the Privacy Act 1988 (Cth). Our security posture is documented in the Trust Centre; we are not SOC 2 certified and do not claim to be.

Agency accounts & client sub-accounts

If you enable agency mode, you can create a separate sub-account for each client businessyou manage. Each sub-account’s contacts, campaigns and history are kept isolated from every other sub-account.

Your Spam Act responsibility flows down to every client you send for.For each sub-account, you are responsible for ensuring that client’s audience gave consent, that sender identification names the right business, and that the Acceptable Use Policy is met — the platform enforces unsubscribe and sender-identity checks on every sub-account exactly as on your own, and we may suspend an individual sub-account or the whole agency account for breaches. Staff you authorise act on your behalf: their actions through your agency account are your actions, and every cross-account action is recorded in the audit history of both the agency and the sub-account.

Sub-account data belongs with the client’s business.The contact lists and campaign content in a sub-account are held for that client; how ownership and handover work between you and your client is governed by your own agreement with them — we act on the agency account’s instructions.

Billing: you choose per-client wallets (each client sub-account tops up and spends its own prepaid credit) or one master agency wallet (your credit pays for all sub-accounts, itemised per client in your ledger). Either way, sends are billed at the same per-message rates as any other account, and there is no additional platform fee for sub-accounts or white-label.

White-label: you can show your own brand name, colour and reply-to on client-facing surfaces. Sender identification, the one-click unsubscribe and the legal footer are never removed or hidden by white-labelling, and sending from your own domain only activates after we verify that domain.

Pricing & prepaid credit

HAMANI Marketing is prepaid, pay-as-you-send. You top up a wallet; sends draw down your balance only when a message is accepted for sending by our delivery provider — $0.01 ex GST per email (the current rate, which we may adjust with notice). Queued, failed and simulated sends are never charged. If our delivery provider later reports that a charged message could not be delivered because of a hard bounce (the address does not exist) or a spam complaint, the per-message charge is automatically credited back to your balance. Prices are in AUD and a GST tax invoice is issued for every top-up.

Prepaid credit has a validity period based on the amount — from 28 days for smaller top-ups up to 365 days for a $1,000 top-up. Unused credit expires at the end of that period. If you top up again before expiry, your unused credit rolls overinto the new validity window. If your balance can’t cover a send, the campaign pauses until you top up — your balance never goes negative.

Promotional pricing may apply to top-up packs for a stated period. During a promotion the discounted price shown at checkout is exactly what you are charged, the tax invoice shows the discounted amount, and the credit value and its validity period are unchanged. A promotion ends at its stated end time; top-ups after that are at the standard prices above.

Cancellation & refunds

There are no contracts or lock-in: you cancel simply by not topping up. Consistent with the Australian Consumer Law (ACL), our consumer guarantees cannot be excluded — where they apply, you may be entitled to a remedy. Nothing in these terms limits those rights.

Acceptable use & suspension

You must follow our Acceptable Use Policy. We may suspend sending if we reasonably believe it breaches that policy or the law.
